These Terms of Service (“Terms”) govern your use of pairrest.com and any purchase from PairRest. By browsing, creating an account, or placing an order, you agree to these Terms, our Terms of Sale, Refund Policy, Shipping Policy, and Privacy Policy.

1. Who we are and what we sell

PairRest sells physical sleep accessories for adults, including sleep masks, mouth tape, sound machines, pillows, and kits. We do not sell supplements, melatonin, medicines, or medical devices.

We use a third-party fulfillment partner. Products are typically packed and shipped from facilities outside Australia. You agree that this is disclosed before purchase.

2. Not medical devices: important safety notice

PairRest products are lifestyle accessories for comfort, light blocking, and sound. They are not medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or condition, including sleep apnea, insomnia, snoring as a medical condition, or any respiratory disorder.

Mouth tape is for generally healthy adults who can breathe comfortably through the nose. Do not use mouth tape if you have nasal congestion, a cold, asthma, sleep apnea, or any breathing difficulty; if you are under 18; or if a clinician has advised against it. Stop use immediately if you feel discomfort, restricted breathing, or skin irritation, and seek medical advice if needed. Keep products away from children and pets.

You are responsible for using products as described. If you have a medical sleep concern, consult a qualified clinician. Nothing on this site is medical advice.

3. Eligibility

You must be at least 18 years old to purchase. You confirm that information you provide is accurate and that you are authorised to use the payment method.

4. Accounts, reviews, and acceptable use

You must not misuse the site, attempt to defraud us, scrape the store, post unlawful or misleading reviews, or interfere with checkout or fulfillment. We may refuse, cancel, or limit orders that appear fraudulent, abusive, or placed in commercial quantities we did not agree to supply. We may remove reviews we reasonably believe are fake, unlawful, or violate these Terms.

5. Orders, pricing, and errors

An order is an offer to buy. We may accept or decline it. A contract is formed when we send an order confirmation. Prices are set in Australian dollars (AUD). USD may be shown as a presentment currency. We may correct obvious pricing, stock, or description errors and cancel the affected order with a full refund of amounts paid for that order.

We may cancel an order if payment fails, the address cannot be shipped, the item cannot be fulfilled, or we reasonably suspect fraud. If we cancel, we refund amounts paid for the cancelled items.

6. Payment

Payment is processed by Shopify and its payment providers (including Shopify Payments). You authorise the charge for the order total shown at checkout, including shipping and any taxes collected at checkout.

7. Shipping, delivery window, and refunds

Shipping, the 21-day delivery window, customs, and refunds are governed by the Shipping Policy, Refund Policy, and Terms of Sale. Please allow 21 calendar days from the order date for delivery before a not-received refund request, except where tracking shows a confirmed failure or consumer law requires a different outcome.

8. Intellectual property

PairRest names, logos, product copy, and site content are owned by us or our licensors. You may not copy, resell, or exploit them without written permission.

9. Limitation of liability

To the maximum extent permitted by law, PairRest is not liable for indirect, incidental, special, or consequential loss, including lost sleep, lost wages, or relationship or health outcomes, arising from use of the site or products.

Where liability cannot be excluded, and where the law allows us to limit it, our total liability for a product or order is limited to the amount you paid for that product or order.

Nothing in these Terms excludes, restricts, or modifies any right or guarantee under the Australian Consumer Law or other law that cannot be excluded. If a consumer guarantee applies and a failure is not a major failure, we may choose to replace, repair, or refund as the law allows.

10. Indemnity

You agree to indemnify PairRest against claims, losses, and costs arising from your misuse of products, your breach of these Terms, or your provision of a false address or payment details, except to the extent caused by our fraud or negligence or where the law prohibits this.

11. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including carrier disruption, customs holds, natural events, epidemics, labour disputes, war, cyber incidents, or failure of a fulfillment partner, provided we take reasonable steps to resume performance or refund as required by law.

12. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Courts of Queensland have non-exclusive jurisdiction, except that consumers may also bring claims in their local courts where the law requires. Please email us first so we can try to resolve the issue.

13. Changes

We may update these Terms from time to time. The version posted on this page at the time you place an order applies to that order. Continued use of the site after a change applies to later use.
